And rightly so. Even if you just stay there yourself - without any rental - the Spanish tax authorities consider this as 'deemed income'.<\/span><\/p><p><span style=\"font-weight: 400;\">For example:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Property with cadastral value<\/b><span style=\"font-weight: 400;\">: \u20ac500.000<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Fictitious rental income<\/b><span style=\"font-weight: 400;\">: 2% = \u20ac10.000<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Load (IRNR)<\/b><span style=\"font-weight: 400;\">: 24% = <\/span><b>\u20ac2,400\/year<\/b><\/li><\/ul><p><span style=\"font-weight: 400;\">\ud83d\udc49 Spanish <\/span><b>residents<\/b><span style=\"font-weight: 400;\"> pay this tax <\/span><b>not<\/b><span style=\"font-weight: 400;\"> at their main residence.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> \ud83d\udc49 <\/span><b>Non-residents<\/b><span style=\"font-weight: 400;\">, including many Belgian and Dutch owners on the Costa del Sol, <\/span><b>does<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5a02a2f animated-fast elementor-widget__width-initial elementor-invisible elementor-widget elementor-widget-text-editor\" data-id=\"5a02a2f\" data-element_type=\"widget\" data-e-type=\"widget\" data-settings=\"{&quot;_animation&quot;:&quot;opal-move-up&quot;,&quot;_animation_tablet&quot;:&quot;opal-move-up&quot;,&quot;_animation_mobile&quot;:&quot;opal-move-up&quot;}\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h2>1. Europe intervenes: formal objection from Brussels<\/h2><p><span style=\"font-weight: 400;\">In June 2025, the <\/span><b>European Commission<\/b><span style=\"font-weight: 400;\"> a <\/span><b>infringement proceedings<\/b><span style=\"font-weight: 400;\"> launched against Spain. According to Brussels, this tax scheme <\/span><b>discriminatory<\/b><span style=\"font-weight: 400;\"> and possibly <\/span><b>contrary to EU law<\/b><span style=\"font-weight: 400;\">.<\/span><\/p><p><span style=\"font-weight: 400;\">The difference in tax treatment of residents versus non-residents - even if both are EU citizens - would undermine the free movement of capital.<\/span><\/p><p><span style=\"font-weight: 400;\">Spain was given two months to respond. If no adjustment follows, the case may be referred to the <\/span><b>European Court of Justice<\/b><span style=\"font-weight: 400;\">. This could have far-reaching consequences for thousands of foreign owners in Spain.<\/span><\/p><h2>2. Spanish ruling: expats under 'Beckham law' also suffer<\/h2><p><span style=\"font-weight: 400;\">On 17 July 2025, the <\/span><b>Tribunal Econ\u00f3mico-Administrativo Central (TEAC)<\/b><span style=\"font-weight: 400;\"> - the highest tax court in Spain - confirmed that expats are also covered by the <\/span><b>'Beckham law'<\/b><span style=\"font-weight: 400;\"> have to pay this tax on their main residence.<\/span><\/p><p><span style=\"font-weight: 400;\">\u27a1\ufe0f This scheme, designed to give foreign professionals attractive tax rewards, thus gets a big haul.<\/span><\/p><p><span style=\"font-weight: 400;\">The consequence?
